Terms
Net 30 days. Infiniti Medical also accepts credit card payments (Visa,
MasterCard, and American Express). Standard deliveries are processed in five (5)
business days with freight/handling/insurance added to each invoice. Expedited
service is available on all orders. A charge of $150.00 is applied for all rush orders.
Custom Product Terms
Payment required in advance. Infiniti Medical accepts
payment by credit card, bank wire transfer or check. Manufacturing of custom
product will commence upon receipt of payment. Production lead times and delivery
vary by product. All custom orders are non-refundable and may not be returned for
credit.
Custom Product Terms
- service charge of 1½ % per month, not to exceed the maximum rate
allowed by law, shall be made on any portion of Buyer’s outstanding balance
which is not paid within net thirty (30) days period.
- All communications regarding billing disputes and payments of any disputed
or delinquent amount must be sent to: Accounting Department, 525
Middlefield Rd. Suite 150, Menlo Park, CA 94025.
- In the event Buyer fails to make payment in full to Seller when due, Buyer’s
entire account(s) with Seller shall become immediately due and payable
without notice or demand.

SHIPPING POLICY
Regular Shipping
All orders, unless specified by the client, fall under the normal processing schedule.
Orders are filled within 4 – 5 business days and ship via FedEx Ground. An approximate
freight and insurance charge of $49 will be applied to all orders, regardless of dimensional
weight or number of boxes. The freight charge may be applied to the recipient’s FedEx
account at their request.
Expedited Shipping
All orders that require delivery before the regular 4 – 5 business days of processing fall under
the expedited processing schedule.
Orders are filled the same day the order is placed, with the recipient’s choice of shipping
method. All orders requiring expedited processing incur a $150 processing fee. This fee
allows the order priority over the entire order queue and available inventory. A FedEx freight
and insurance charge will also be applied. Freight charges will vary depending on
dimensional weight and number of boxes in the shipment. The freight charge may be applied
to the recipient’s FedEx account at their request.

PRODUCT RETURN POLICY
Return Authorization:
Before an Infiniti Medical product is returned for credit
consideration, approval for the return must be requested by phoning Infiniti Medical
customer service +1650-327-5000.
Returns may be subject to a 20% restocking fee.
Return of Products:
The customer must provide all of the following information for
the products to be considered for a return authorization approval and credit
processing:
- SKU # and quantity of each item to be returned
- Invoice number and purchase order number (if available)
- Reason for return
Condition of Returned Goods:
All products, which are in saleable condition, may be
returned for credit. Products are generally not considered saleable if:
- Discontinued from sale
- Custom product
- Packaging is opened
- Damaged
- Used
- Expired
Credit policy for unused products:
Credit will be given only after product has been
received and inspected.
Credit will be given for merchandise:
- in saleable condition
- Shipped in error by Infiniti Medical
- Returned at the request of Infiniti Medical
All returned goods (in saleable condition) must be received by Infiniti Medical within
30 days from the date of purchase (determined by the invoice date).
Return Location:
All products should be returned with freight and insurance prepaid
by the customer within 5 business days of receiving Return Authorization approval.
All returned products must be accompanied by the return authorization number
written on a copy of the original invoice and sent to:

Damage during shipping:
Infiniti Medical uses a third party shipping agent and fully
insures each order. Damage during delivery is therefore the sole responsibility of the
shipping company. Orders should therefore be thoroughly inspected when received.
Claims for damaged goods must be subrogated with the shipper. Infiniti Medical
cannot accept returns on merchandise damaged during shipping.

LIABILITY
- Seller shall not be liable for any loss of use, revenue or anticipated profits, or
for any incidental, unforeseen, punitive or consequential damages arising out
of or in connection with these Terms and Conditions or the sale or use of any
products.
- Except as may be implied by law, in the event of any breach of these
Conditions by the Seller, the remedies of the Buyer shall be limited to
damages which shall in no circumstances exceed the price of the Products
stated on the Shipping Confirmation.

FORCE MAJEURE
Seller shall not be liable for damage or loss occurring as a result of any delay or
failure of performance due to any causes beyond Seller’s control, including, without
limitation, any act of God, act of Customer or any of its representatives or agents,
embargo or other governmental act, regulation or order, fire, flood, freezing, storm,
accident, explosion, strike, slow down, labor disturbance, war (whether declared or
not), riot, delay in transportation, inability to obtain necessary labor, materials, fuel or
manufacturing facility problems or any other circumstance whether similar or
dissimilar to the foregoing. In the event of such delay or failure, the date of delivery
shall be extended for a period equal to the time lost by reason of such delay or failure.
In no event shall the obligation of Buyer to pay for delivered Products be suspended.
In addition, if due to any such use, Seller is unable to produce sufficient Products to
meet all demands from customers and internal users, Seller shall have the right to
allocate production among its customers in any manner which Seller may determine to
be equitable.

CHOICE OF LAW
Any action arising out of or relating to these Terms and Conditions or the sale or use
of any Products shall be brought only in San Mateo County Superior Court or the
United States District Court of California. Buyer hereby consents to and waives any
objection to venue and personal jurisdiction in any such action. These Terms and
Conditions and the relations between Seller and Buyer shall be governed by the laws
of the State of California

SERVICE AND WARRANTY
Disclaimer of Warranty and Limitation of Remedy:
THERE IS NO EXPRESS OR IMPLIED WARRANTY, INCLUDING ANY
IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, ON INFINITI MEDICAL PRODUCTS. UNDER
NO CIRCUMSTANCES SHALL INFINITI MEDICAL BE LIABLE FOR ANY
DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OTHER THAN
AS EXPRESSLY PROVIDED BY SPECIFIC LAW. NO PERSON HAS THE
AUTHORITY TO BIND INFINITI MEDICAL TO ANY REPRESENTATION
OR WARRANTY EXCEPT AS SPECIFICALLY SET FORTH HERIN.
Service and liability:
Mechanical devices are designed to perform reliably. In spite of
the care exercised in design and manufacturing, it is impossible to eliminate
malfunctions due to ordinary wear and tear and to random component failure.
Accordingly, Infiniti Medical agrees that when the product is used and maintained in
accordance with the instructions, it will, at its option, replace or repair the unit on a
no charge basis for 30 days following the date of purchase.
In view of the varied conditions under which each unit will be used, all products are
sold "as is" and Infiniti Medical's responsibility does not go beyond the terms set forth
above

INTENDED PRODUCT USAGE/STORAGE
Usage:
Most Infiniti Medical products are supplied sterile and non-pyrogenic. Do not
use any product if its sterile package is damaged. Discard catheters and single use
accessories after one procedure. All parts are difficult to clean.
DO NOT REUSE OR RESHAPE PRODUCTS. DO NOT AUTOCLAVE SINGLE
USE PRODUCTS OR ATTEMPT TO RESTERILIZE. STRUCTURAL
INTEGRITY AND/OR FUNCTION MAY BE IMPAIRED THROUGH THE
RESHAPING AND CLEAINING PROCESS. ACCORDINGLY, INFINITI
MEDICAL WILL NOT BE RESPONSIBLE FOR ANY DIRECT, INCIDENTAL
OR CONSEQUENTIAL DAMAGES RESULTING FROM REUSE OF INFINITI
MEDICAL EQUIPMENT
Storage:
Store products in a cool, dark, dry place. Do not expose to organic
solvents.
